Building Safety Act

Plain English. Practical detail. UK context.

The Building Safety Act 2022 introduced a broad reform framework for building safety, accountability and redress. Its provisions and related regulations have different scopes and commencement dates. It is not simply a rule for tall buildings, nor a guarantee that every homeowner is exempt from all defect costs.

Separate general duties from the higher-risk regime

Government guidance on design and building work explains competence and dutyholder requirements under England's 2023 Building Regulations amendments. These concern relevant design and construction work more broadly, while higher-risk projects have additional requirements. The Act's title alone does not determine the route. Homeowners should establish the actual building and work with competent advisers. Tradespeople need to know the applicable duties before accepting responsibility. A trainee should not be appointed to a principal role requiring competence they have not developed, or work unsupervised beyond their capability.

Similar role names can have different purposes

Principal designer and principal contractor roles under Building Regulations concern compliance of design and work. CDM roles address health and safety during construction. Government guidance distinguishes their competence requirements and coordination, even where the same organisation holds both appointments. Do not assume an appointment letter for one automatically documents every other role. Domestic-client arrangements also need checking rather than applying all commercial duties unchanged. Clear appointments, information and time for competent work matter more than merely adding a title to a quotation.

Higher-risk work needs its actual process

Building Safety Regulator approval, change control, competence information, completion and building information can involve additional requirements where the higher-risk criteria apply. Criteria and procedures can differ between construction and occupation contexts. Do not classify a building from a single informal height estimate or assume every flat is automatically within the same regime. Trainees should understand which records and changes require escalation. A programme or commercial deadline is not a reason to proceed without the required approval or conceal a departure from the assessed design.

Homeowner protections need individual assessment

The Act includes leaseholder protections and other redress measures, but eligibility, building circumstances, costs and legal tests matter. The government's introductory page is a starting point, not a personalised legal conclusion. Current detailed guidance and suitable legal advice may be needed. Prices and outcomes vary from job to job, so compare written, itemised quotations rather than relying on a typical figure. England's detailed regime must not be applied unchanged throughout the UK. Homeowners should retain relevant contracts, approvals and building records, while tradespeople should keep accurate information and refuse work beyond competence. Compliance is an active project responsibility, not a certificate obtained after unsafe or non-compliant decisions have already been made.

Frequently asked questions

Does the Act only matter on high-rise projects?

No. Distinguish general relevant duties from additional higher-risk-building requirements.

Are CDM and Building Regulations principal roles identical?

No. They have different purposes and competence requirements, even if held by the same organisation.
